Privacy is very important to us and we will make every effort to ensure that all information provided by you is protected. The Policy explains how Labtones.com collects and uses information and applies to members of Labtones as well as non-members. Although we endeavour to keep you upto- date on all changes made to the Website, this Policy may be amended from time to time without notice to you. It is your responsibility to read the Policy carefully and review any changes that may have been made.

1. Who is Labtones?

Labtones.com ('Labtones' or 'we' 'our' or 'us') is an online network for independent artists and listeners. Labtones.com is registered at the Chamber of Commerce, no. 24329127 and having its registered office in Dordrecht, The Netherlands ('Labtones.com') – which are applicable to the services of Labtones.com, described as Labtones.

2. E-mail notifications

We dislike spam probably as much as you do, and therefore we will rarely sent you an e-mail with news about Labtones (usually all you need to know can be found on the 'News' page). An e-mail notification system is used to inform you about new messages, notes, friend requests, etc. If you do not wish to receive these notifications you can easily disable them through your 'Edit profile' page.

3. Personal information

In order to be able to make optimum use of the Labtones.com website, you have to create a personal account, either as an artist or as a listener. When you create such an account, you complete certain information about yourself. Only a couple of details are obligatory, and you can always adjust the information you have provided. Please note that even if you do not provide any additional personal information to the Website (e.g., by adding it to your user profile), if you choose a username that includes or reveals your name or any other personal information, such information may be available to other users of the Website and to the general public. For purposes of this Policy, the terms 'personal information' and 'personally identifiable information' shall mean all information provided during your initial registration on the Website and during your creation of a user profile, including, for example, your real name, e-mail address, postal address and other location information, your age, your gender and certain other demographic information or information that may enable online or offline contact with you. Where you upload photographs or other content as part of your user profile, you should be aware that Labtones.com is entitled to use those photographs and content in accordance with our Terms of Use. Labtones.com discourages users from uploading photographs of friends or other people without their permission.

4. Automatically generated data

Labtones.com also collects automatically generated information about your surfing behaviour during your visit of the website. This information consists for example of your IP address, the browser type that you visit and cookies. We log certain information concerning the listening, rating and music-sharing activities of users and other activities whilst they use the Website, and we may match such information with personally identifiable information concerning such users. For example, it is possible for us to know which songs you listen to, which you rate, and which you add to your mixtape. Please note that we do log and use statistical information in the aggregate. For example, we know the mean rating for a certain song, and what types of listeners visited an artist's profile. As a service, we may supply certain aggregate statistical information to record labels and artists that allow us to stream their music on Labtones.com in order to help them understand the likes and dislikes of their listeners.

5. Cookies

In order to perform the Services Labtones.com uses cookies saved by your browser on your computer. Cookies are little bits of information sent by our server to your server with the aim that on your next visit the information is again returned to our server. These little text files are saved on the hard disk or in the memory of your computer. Cookies cannot damage your computer or the files stored on your computer. Information is stored in the cookies (such as your user name and preferred language) in order to make any next use of Labtones easier. Apart from your IP address this information does not include a name or address details or other personal details. You can adjust your browser so that you don’t receive any cookies during your next use of Labtones. However, in that case it may happen that you cannot use all the opportunities of Labtones. If you do want to make use of cookies, make sure that you log out if you leave a public computer. Also keep your password secret in order to avoid others using your account without your consent.

6. How is information about you used by Labtones.com?

Labtones will use information about you for the following purposes:

a) To communicate with you about Labtones and send information to you about our own services;

b) To adjust Labtones to your wishes and needs;

c) For protection purposes and to formulate rendered anonymous statistical data.

As stated above, your IP address is also included in the automatically generated data. Labtones records these addresses in order to determine the computers from which Labtones is visited to protect attempts at hacking. But when Labtones members are harassed or with regard to fake profiles of existing persons we can also use these data to retrieve the perpetrators. Labtones also uses the automatically generated data for drawing up rendered anonymous user statistics. Labtones may provide automatically generated data, including your IP-address, to third parties that draw up user statistics for Labtones and that perform web analyses.

7. Communications with other users

We currently offer the possibility to send notes and private messages to other users and in the future we may offer other interactive features, such as instant messaging and chat. Please note that all personal information you display or communicate using notes becomes public information and we are not responsible for any information you choose to make public. We may, but have no obligation to, monitor traffic via electronic software or otherwise in order to check for obscenity, defamation or abusive language, which we reserve the right to remove at any time. In addition, if you choose to personally communicate or meet with any other Labtones.com user by exchanging postal/email addresses, telephone numbers or otherwise via the interactive functionality of Labtones.com, you do so at your own risk. Labtones.com cannot be held responsible for any consequences which flow from your decision to communicate or interact with other Labtones.com users in places or under circumstances which we do not control. We advise you to use extreme caution whenever you post information, socialise or interact with people whom you have met via the internet. From time to time, you may be able to send to a friend, and a friend or contact may be able to send to you, information about our Website or services (e.g., to provide you with access to a song or message), by clicking on an 'E-mail-a-Friend' or similar button on the Website or other third-party websites. In some of these cases (unless you simply forward an e-mail from Labtones.com on your own), you, or your friend, may be able to provide your friend’s, or your, name and e-mail address to us. Such information will be treated in accordance with this Privacy Policy and applicable law. If Labtones.com receives your email address in this way and you are not an existing registered user of the Website, Labtones.com will delete your email address immediately after providing you with the song or message.

8. Third parties

We may use third-party advertising companies to target and serve ads when you visit our Website. These companies may use information about your visits to this and other Web sites in order to provide advertisements about goods and services of interest to you. These companies may employ cookies and other tracking technologies to measure advertising effectiveness. Any information that these third parties collect via cookies is generally not personally identifiable (unless, for example, you provide personal information to them through an ad or e-mail message). We encourage you to read these businesses' privacy policies if you should have any concerns about how they will care for your information. If you choose to purchase music or other goods or services by clicking on a third party link provided on the Website, a third party may collect your personal details (such as your credit card number, address, etc.) for the purpose of completing a transaction. We may be provided with confirmation of your transactions with such third parties and, in some instances, such confirmation may include your personal information. Aside from such confirmations, the only information that we will collect with respect to such third party links is: (a) the number of generic Labtones.com users who utilised such links; and (b) the number of purchases made by these generic users.

9. How does Labtones.com protect your personal information?

Labtones will take suitable technical and organisational measures to protect your (personal) details against loss or against any form of unlawful processing. For instance passwords are saved in a coded form so that nobody has access to it even at Labtones Headquarters.

10. Legally-compelled disclosures

We believe in privacy and therefore will take all reasonable measures to ensure that your personally identifiable information remains private. However, in the event that we are required to disclose personally identifiable information by a court, the police or other law enforcement bodies for their investigations, regulation or other governmental authority we will make such a disclosure without being in violation of this Policy.

11. Transfer of data to countries outside of the EU

For technical and operational reasons it may be necessary for your (personal) details to be transferred to (servers of) companies affiliated to us and/or Advertisers in the United States or other countries outside Europe where the regulations in the field of privacy protection might not provide the same protection as in the European Union. Insofar as this is necessary, you hereby agree that your (personal) details can be transferred to the United States or other countries outside Europe.

12. Examination and improvement of your own details

You can always view your own (personal) details and if necessary change them in your account. If you want to know which details Labtones.com has recorded about you or if you want to change details which you cannot change in your account, you can send a question via the contact form on our website.

13. What is the scope of Labtones' responsibility?

Labtones may include hyperlinks (for instance in banners) via which you leave Labtones and end up on the websites of another party. Labtones has no power over the websites of third parties to which you are linked. So it may be the case that a different privacy policy is applicable to the use of these third party websites. This Privacy Policy only relates to (personal) details which have been obtained via the Labtones website. Labtones does not accept any responsibility or liability for (the operation and/or contents of) websites of third parties.

14. Are minors allowed to use Labtones?

Everyone of 13 years of age and older can can use Labtones and can create a Labtones account. However, it is important that special legal rules apply to persons who are not yet sixteen (16). If you are not yet sixteen (16) you are required to obtain the consent of your parents or guardian before you create a Labtones account. By accepting this Privacy Policy you guarantee that you are at least sixteen (16) years of age or have the consent of your parents/guardian to create an account.

15. Business transitions

If Labtones.com is acquired by another company or sells all or a portion of its assets to another company, or in the event of a merger, it is likely that user information will be a part of the assets transferred. If as a result of such a business transition information is to be collected, used or disclosed in a manner or for a purpose different from that stated above, Labtones.com will endeavour to notify all users of such changes beforehand.
